Lebanon couple pleads no contest in death of child
A Lebanon couple pleaded no contest Friday, Jan. 27, in Linn County Circuit Court to criminal negligent homicide in the 2021 death of their child.
They also entered pleas of no contest to two counts of endangering the welfare of a minor.
According to court documents, John David Hutchings, now 29, and Kaitlyn Rose Hutchings, 24, negligently caused the death of 17-month-old Jaelyn Hutchings on Sept. 23, 2021.
Documents also allege that the girl was left unattended for a period likely to endanger her welfare, as were two other children, all of whom were under the age of 10.
Other charges refer to the victims being in a place where unlawful activity involving controlled substances was maintained or conducted.
The couple was charged May 12, 2022, with second-degree manslaughter, first-degree criminal treatment, three counts of second-degree child neglect and three counts of endangering the welfare of a minor.
If accepted, John Hutching’s plea deal stipulates that he may be sentenced to 18 months with the Oregon Dept. of Corrections and 36 months of postprison supervision.
Kaitlyn’s plea deal would include the possibility of time with the Oregon Dept. of Corrections, 36 months supervised probation with parenting classes, 30 days in jail, a $200 fine, entrance into a drug program, no use of drugs and no drugs allowed around her other children, and no work in a childcare capacity.
The Hutchings each posted 10% of a $50,000 security in May 2022.
Circuit court
Warrants are out on the following individuals: Shelby Keith Brigham, Brent Edwards Bowers, Selina Renee Ford-Blackburn, Steven Michael Cooley, Jessica Jo Gambee, Ethan Joel Goins, Julianna Marie Goins, Matthew David Griner, Aaron Thomas Halvorson, Dustin Neal Herron, Devin Michael Houseman, James Andrew Linder, Christopher Lee Hurt, Faron Walter Kennedy, Mikel Vincent Lizama, Jay Boyd Marsh, Kasey Wayne Miller, Dustin James Phares, Colton Michael Robert Rictor, Lerae Nicholle Ruck, Tara Ann Stanley, Curtis Martin Sly, Joshua Joe Tallman and Darnell T. Wells.
Shawn Eric Aman, 51, appealed a 2020 DUII citation and a separate 2020 case for which a jury found him guilty of driving while suspended and failure to carry or present a license. On Jan. 31, 2023, the court dismissed both cases with prejudice after the City of Lebanon failed to produce evidence.
Israel Anaya, 27, was sentenced Feb. 22 to 150 months with the Dept. of Corrections, 36 months post-prison supervision and $13,948.61 in fines and restitution based on a plea of guilty to attempt to commit any degree of murder or aggravated murder – second-degree murder, unlawful use of a weapon – firearm, and felon in possession of a firearm. Charges of first-degree assault and unlawful use of a weapon were dismissed.
The charges to which he pleaded guilty involve the attempted murder of a female in Marion County.
Taylor Randall Becker, 26, was placed in the diversion program after entering a no-contest plea for an alleged DUII with a .20% BAC.
Brent Edwards Bowers, 25, was charged Feb. 27 with unauthorized use of a vehicle and DUII.
Chuck Earl Breshears, 54, was charged March 3 with DUII and reckless driving.
Eric Bruce Buckner, 49, was placed in the DUII diversion program after he pleaded guilty to the charge with a .13% BAC.
Rodney Allen Camper, 32, was charged March 6 with first-degree rape constituting domestic violence, fourth-degree assault constituting domestic violence and two counts of menacing constituting domestic violence. Security was set at $150,000.
Daniel Joseph Carrico, 39, was sentenced Feb. 17 to five years suspension of a driver’s license, 36 months supervised probation, 15 days jail and a $15,579.17 compensatory fine/restitution based on a plea of no contest to two counts of third-degree assault. Charges of reckless driving, second-degree criminal mischief and failure to perform the duties of a driver to injured persons were dismissed.
Jordan Ethan Davis, 25, was sentenced Feb. 13 to 24 months bench probation and 10 days jail after pleading no contest to second-degree escape. The charge was reduced to a misdemeanor.
George Earl Scott Dunn Jr., 20, was sentenced Feb. 16 to 10 days compensatory service based on a plea of no contest to second-degree criminal mischief, resisting arrest and failure to appear.
Alejandro Estrella, 31, was sentenced Jan. 9 to 24 months supervised probation, 240 hours jail and a $100 fine after he pleaded guilty to fourth-degree assault constituting domestic violence.
Michael Travis Flanigan, 28, was charged March 7 with unauthorized use of a vehicle.
Dakotah Lane Hodson, 25, was sentenced Feb. 24 to 18 months supervised probation, 30 days jail and a $100 fine for a no-contest plea to unlawful possession of a firearm. Charges of felon in possession of a firearm and giving false information were dismissed. In a separate case, Hodson was sentenced to one year suspension of a driver’s license, 18 months supervised probation, 240 hours jail and a $200 fine, and was placed in the diversion program for a DUII charge after pleading no contest. Two counts of reckless driving were dismissed.
KC Everett Merle Holt, 40, was sentenced Feb. 17 to 24 months with the Oregon Dept. of Corrections and 12 months post-prison supervision based on a plea of no contest to three counts of identity theft. An additional three counts of identity theft were dismissed.
Curtis Raymond Hughes, 48, was charged Feb. 16 with felon in possession of a firearm.
Shawn Luke Jayne, 32, was charged Feb. 13 with strangulation.
Isaiah Alan Ledford, 21, was sentenced Feb. 17 to 30 days jail and $300 in fines based on a plea of no contest to first-degree theft and second-degree criminal mischief. A second-degree criminal trespass charge was dismissed. In a separate case he was sentenced to 18 months with the Oregon Dept. of Corrections, three years post-prison supervision and $400 in fines on a no contest plea to first-degree burglary of an occupied dwelling and first-degree theft. Other charges of first-degree aggravated theft, two counts of second-degree criminal mischief, unauthorized use of a vehicle, first-degree theft, first-degree burglary, unlawful entry into a motor vehicle, reckless driving and two counts of identity theft were dismissed.
Jeremy Lewis Matlock, 37, was charged Feb. 24 with first-degree burglary, six counts of first-degree theft, unlawful possession of marijuana and unlawful possession of a firearm. Theft charges allege Matlock stole six firearms. Security was set at $40,000.
A case against Kenneth Charles McDaniel, 46, for first-degree theft, felon in possession of a restricted weapon, second-degree criminal mischief, second-degree criminal trespass and failure to appear was dismissed with prejudice.
Jeremiah Robert McGuigan, 24, was placed in the DUII diversion program after pleading no contest to the charge with a .12% BAC.
James Frank Newport, 33, was sentenced Jan. 18 to 30 months with the Oregon Dept. of Corrections, 24 months post-prison supervision and a $200 fine based on a plea of no contest to unlawful use of a weapon. Another charge of unlawful use of a weapon and two counts of recklessly endangering another person were dismissed.
Newport was arrested for firing shots within a residence Sept. 11 on W. Vine Street that damaged nearby buildings and a vehicle. Court documents state contraband seized will be forfeited for disposition in the manner provided by law; this includes the Glock 19 red/black with four magazines, Glock 45 green, CZ 9 mm, Angstadt 9 mm AR pistol with magazine, Sharps Bros .223 AR pistol, Stribog SP9A3 9 mm and any ammunition found outside the gun safe. All items in the gun safe will be released to any lawful owner or person whom the defendant designates. This includes a SW M&P 9 mm, Ruger LPC .380, CZ 75 9 mm with two magazines, S&W M&P 9 mm, S&W M&P .22, P30 Glock (lower) and New England Firearms 12-gauge sawed-off shotgun.
John Wayne Moe, 313, was charged March 6 with three counts of fourth-degree assault constituting domestic violence, menacing constituting domestic violence, third-degree robbery and interfering with making a report.
James C. Pearsall, 36, was charged March 2 with unlawful use of a weapon and fourth-degree assault. Court records allege Pearsall discharged a weapon within city limits. He posted 10% of a $10,000 security.
Christy Renee Pedigo, 30, was sentenced Feb. 14 to 36 months supervised probation, 15 days jail and a $200 fine on a plea of no contest to unlawful use of a weapon. Charges of attempt to commit a class B felony, fourth-degree assault and first-degree failure to appear were dismissed.
Rafael Antonio Ramos, 20, was placed in the diversion program after pleading no contest to DUII (with a .13% BAC), second-degree criminal mischief and reckless driving. He was sentenced to 24 months bench probation, three days jail and a 90-day driver’s license suspension for a charge of failure to perform the duties of a driver when property is damaged on the no-contest plea.
Morgan Rachael Rand, 33, was sentenced March 6 to 12 months bench probation, five days jail and $200 in fines based on a no contest plea to second-degree theft, harassment and attempt to commit a Class A misdemeanor fourth-degree assault. A third-degree robbery charge was dismissed.
Garland C. Richtsmeier, 55, was charged March 3 with second-degree assault. Security was set at $50,000.
Lerae Nicholle Ruck, 22, was charged Feb. 28 with two counts of unauthorized use of a vehicle.
Timofey Nikolayevich Samoylich, 41, pleaded no contest to unlawful possession of heroin and was deferred to the Linn County Drug Court Program and placed on 24 months supervised probation.
Rosemary O. Saviour, 24, a resident in Illinois, was charged Feb. 23 with identity theft, second-degree forgery and second-degree criminal possession of a forged instrument. She posted 10% of a $30,000 security. Court records indicate Saviour allegedly committed identity theft by assuming a name (either real or imagined) and committed forgery by opening a forged account at Umpqua Bank in Lebanon.
Dominik Alan Brian Schermerhorn, 20, was sentenced Feb. 17 to 70 months with the Oregon Dept. of Corrections, 36 months post-prison supervision and registration as a sex offender based on a plea of guilty to third-degree rape, third-degree sodomy, strangulation constituting domestic violence and two counts of using a child in a display of sexually explicit conduct. Other charges of first-degree sexual assault (x4) and first-degree sodomy (x2) were dismissed.
John Patrick Schulte, 73, was sentenced Feb. 24 to 36 months supervised probation and a $100 fine based on a no contest plea to unlawful use of a firearm. A menacing charge was dismissed.
Melissa Nicole Smith, 46, was charged March 3 with three counts of identity theft and two counts of giving false information. Security was set at $50,000.
Robert Allen Whitley, 68, was sentenced Feb. 6 to 13 months with the Oregon Dept. of Corrections, 12 months post-prison supervision and $2,637 restitution based on a plea of no contest.
Troy Steven Williamson, 21, was charged March 7 with tampering with a witness, driving uninsured, driving while suspended, reckless driving, unlawful possession of firearms and failure to perform the duties of a driver when property is damaged.
Lamar Lavonne Wilson, 33, was charged Feb. 27 with three counts of third-degree rape and one count of third-degree sodomy. Court documents indicate the allegations involve a female under the age of 16.

7:28 p.m. – John Moe, 31, of Lebanon, was arrested for felony domestic violence, fourth-degree assault, fourth-degree domestic assault, third-degree robbery, menacing and interfering with making a report, 41200 block of Baptist Church Drive. According to the Sheriff’s Office, this was a domestic disturbance in which the victim was assaulted multiple times throughout the evening. 8:44 a.m. – Austin Zehner, 25, of Lebanon, was arrested for violation of no-contact order and giving false information to police. Transported to Linn County Jail. Deanna O’Neill, 22, of Stayton, was cited for careless driving and failure to provide proof of insurance. 2:34 p.m. – Report taken for dog bite, Mountain River Drive. Caller reported that her son was walking home from school when a dog charged and bit him. The owner was cited for dog bite.
3:55 p.m. – Report taken for violation of a court-ordered release agreement. The subject sent the victim a message via Cash App while he was not allowed to make contact.
7:32 p.m. – Deputies took a report of a stolen vehicle, 30300 block of Horseshoe Loop. Caller reported that he’d loaned a rented 2021 Black Dodge Ram 2500 to a friend, who never returned it. Investigation continuing.

7:14 a.m. – Nicklaus Glasser, 33, was cited for a Lebanon Municipal Court warrant for failure to appear on an original charge of harassment.
1:15 p.m. – Report taken for the theft of Milwaukee and DeWalt tools from car, Ash St. Loss valued at $1,600. Damage valued at $2,900.
2:37 p.m. – Caller reported a hit-and-run in the 33700 block of Santiam Hwy. According to the caller, a green older-model Ford panel van hit his work vehicle while parked at Yuvi’s Market. The crash caused damage to the driver’s side door of the van. Suspect was a white male, no further description. Investigation ongoing. Report taken.
5:06 p.m. – Caller reported being approached by a male and female with three children, all apparently of Middle East descent, in the parking lot at the Walmart Supercenter, 3290 S. Santiam Hwy. The male said he was wealthy but lost his wallet and ID, and offered to sell his jewelry so he could travel to Ohio. The family was dressed like it had money and drove a luxury SUV. The caller paid $300 for the jewelry and took it to a pawn shop, where he was told it was fake. A pawn shop employee said the same scam had happened 10 times recently.

3:18 a.m. – A single-vehicle crash was reported in the 36100 block of Airport Drive. According to Sheriff’s Office, Dakota Ferrell, 28, of Lebanon was driving a 1991 Audi westbound on Denny School Road when he left the road and crashed into a fence. No injuries reported. Report taken.
9:31 a.m. – Aaron McCready, 42, of Lebanon, was cited for driving uninsured, 38000 block of River Drive.
3:48 p.m. – An elderly male reported as missing was located at Elmer’s, sending money to a scammer, According to Sheriff’s Office, the victim had been contacted by scammers pretending to be U.S. Marshals, by phone, and instructed to drive around to Bitcoin transfer machines at various locations and send money. According to LCSO, this is a common scam, to which the victim is told not to answer any calls, not to tell anyone where they are, or what they’re doing. According to LCSO, money had already been sent to scammers, but a deputy found and stopped the victim before he sent $10,000 more as intended. 33900 block of Bond Road. Report taken.

2:50 p.m. – Store owner reported that on Feb. 1 three “young boys” entered and stole condoms. The owner wanted their parents contacted. Guardians for all three were contacted by the Sheriff’s Office and assured authorities that they would handle it. 34000 block of E. Lacomb Road.
4:48 p.m. – Multiple stolen vehicles were recovered from a rural property in the 31300 block of Bellinger Road. Report taken. According to the Sheriff’s Office, a 2004 Ford F250 stolen from Salem and a 2005 Ford F350 stolen from Albany were located in the back of a remote property. The two trucks were stuck in mud and abandoned. No one was located in the area. An excavator was used to pull the trucks from the mud so they could be returned to the owners. Report taken.

10:22 a.m. – Stolen license plates were recovered following a traffic complaint in the area of Bellinger/Berlin roads. A Sheriff’s deputy on routine patrol conducted a records check on a vehicle and discovered the plates had been stolen Jan. 12.

5:09 p.m. – Caller reported losing $1,000 worth of gift cards via scam email, 33800 block of Old Bellinger Scale Road. According to Sheriff’s Office, the caller received an email stating that she needed to reverse a charge on her bank account by paying the suspect in gift cards. The caller went to Target and purchased $1,000 in cards and provided them to the suspects online. The victim is 82 years old. Report taken.
7:10 p.m. – Sarah Loeks, 31, of Lebanon, was arrested for first-degree burglary, third-degree robbery and second-degree criminal mischief, 39100 block of River Drive. According to Sheriff’s Office, Loeks “went to the location and entered the home unlawfully, stealing a backpack and punching the owner in the face. She then broke the visors of his vehicle prior to leaving. The victim and suspect are known to each other and this was not a random act.” Report taken.
10:23 p.m. – Caller reported a hit-and-run involving damaged property, 600 block of Crowfoot Road. According to the Sheriff’s Office, the vehicle drove off the roadway and struck a telephone pole and a private fence. The vehicle was found a short time later, and Albany and Oregon State police assisted the LCSO in searching for the driver (occupants). The suspect is believed to be the registered owner. 2:55 p.m. – Report taken for recovery of stolen car, Milton St. Officers followed the car through town and identified Dakotah House as the driver. They discontinued a pursuit when speeds were unsafe. The car was found abandoned a half-hour later, and House was seen running toward Seven Oak School, where he ditched his backpack, which contained a gun. A drone was employed to look for House in a patch of trees behind the school.
6:23 p.m. – Caller reported a delivered package contained marijuana items. The package was addressed to a recipient in Idaho but marked “return to sender.” The return address belonged to the caller, but the item was not mailed out by anyone at the home.
6:39 p.m. – Caller reported a theft from a vehicle in the 700 block of Kees St. An electric winch valued at $1,000 was missing. Report taken.
6:50 p.m. – A Walmart employee reported a male brought his dog into the store, where the animal began urinating on store displays. The male was asked to leave and he became “belligerent.”
7:37 p.m. – Deputy responded to an overdose in which a male had reportedly used Fentanyl, 2100 block of Mill St. The male recovered after Narcan was administered.
10:37 p.m. – Eric Wright, 36, of Lebanon, was cited for driving while suspended, failure to register vehicle, failure to carry proof of insurance and failure to obey safe towing regulations following traffic stop in the 2400 block of S. Santiam Hwy.

5:06 a.m. – Darrel Hodson, 59, of Lebanon, was cited for driving while suspended and transported to Linn County Jail on a warrant. Report taken.

9:39 a.m. – Caller reported a yelling male in a gray van, Santiam Hwy. The suspect then reportedly left the vehicle and ran around it three times before getting back in and taking off.

Feb. 6
12:03 a.m. – Caller reported a burglary at Yuvi’s Market, 33700 block of Santiam Hwy. According to the Sheriff’s Office, rock was thrown through the building’s window as a means to gain entry. One male broke the window while another entered the store and stole 20-plus cartons of cigarettes. Cigarette theft is valued at $2,000, and the broken window is valued at $1,500. Deputies reviewed security footage which showed that three men were responsible. Report taken.

12:38 a.m. – Kasha Angelene Carper, 35, was cited for a warrant.
