The Linn County Planning and Building Department has received an appeal of its decision to approve a marijuana production operation at 34225 Kowitz Road.
“Oregon water rights are granted for a specific portion of an agricultural property,” William and Suzanne Bond stated in their letter of appeal, which included a water rights map from the Oregon Water Resources Department.
“The irrigable area drawn on the map completely excludes the proposed hoop houses and green houses as diagrammed on the Kaya Farms Ag. Facility site plane,” the Bonds said. “Because the proposed growing sites do not have any right to water from Beaver Creek, the site plan should be denied.”
The appeal will go before the county Planning Commission in a public meeting. The date had not been scheduled by the time Lebanon Local went to press.
