LINN COUNTY CIRCUIT COURT

Wells
Lawrence Louis Agnot, 24, was sentenced Oct. 28 to a lifetime revocation of a driver’s license, 90 days jail, 24 months supervised probation and $2,255 in fees and fines for a DUII charge with a .19% BAC based on a no contest plea. Charges of reckless driving and failure to perform the duties of a driver when property is damaged were dismissed.
Sonny Allen Agrelius, 24, was charged Oct. 21 with unlawful possession of and attempted unlawful delivery of methamphetamine. Bail was set at $10,000. For charges of unauthorized use of a vehicle and failure to appear, Agrelius was sentenced Oct. 24 to one year suspension of driver’s license, 30 months with the Dept. of Corrections, 12 months post-prison supervision and $2,324.83 in fines and restitution based on a guilty plea. Charges of giving false information and failure to appear were dismissed. In another case, he was sentenced to 15 months concurrent with Corrections, 24 months post-prison supervision and a $200 fine based on a no-contest plea for unlawful possession of methamphetamine. An attempted unlawful delivery of meth/Class C felony charge was dismissed.
Jesse James Baugus, 28, was charged Oct. 20 with DUII and reckless driving.
James Allen Bolman, 63, was sentenced Nov. 9 to 24 months bench probation, 90 days jail and court monitoring services for charges of menacing and attempting to commit a felony (assaulting an officer) based on a no-contest plea. Charges of unlawful use of a weapon and second-degree disorderly conduct were dismissed.
A charge of first-degree criminal mischief against Jeffrey David Brennan Jr., 42, for damaging a wheelchair owned by the Linn County Sheriff’s Office was dismissed on Oct. 25.
Daniel Joseph Carrico, 37, was charged Oct. 17 with failure to perform the duties of a driver to injured persons (a Class C felony), reckless driving, second-degree criminal mischief and two counts of fourth-degree assault. Court documents indicate that Carrico allegedly did not stop and render assistance in a collision that injured two victims.
Rohan Alexander Duncan, 44, was sentenced July 21 to 20 days jail and 36 months probation for fourth-degree assault constituting domestic violence based on a no-contest plea. Charges of second-degree assault and unlawful use of a weapon were dismissed. He signed a declaration of firearms surrender on Sept. 6 indicating that he had no firearms in his possession at the time of the court order and does not currently possess firearms.
Caleb Rosburg Fry, 37, was charged Oct. 19 with four counts of first-degree sexual abuse for allegations taking place between Nov. 1, 2021, to Oct. 18, 2022, involving a female under the age of 14. Bail was set at $100,000.
A charge of unauthorized use of a vehicle against Jamie Joy Gardner, 39, was dismissed with prejudice Oct. 25.
Michelle Lena Johnson, 57, was ordered to the diversion program Oct. 18 for a DUII, BAC .17% charge.
Zachary Christopher Kempton, 30, was sentenced Nov. 2 to 240 hours jail and a $100 fine based on a no-contest plea for failure to appear. Other charges of first-degree theft and failure to appear were dismissed. He was also sentenced to 18 months with the Oregon Dept. of Corrections, 36 months post-prison supervision and a $200 fine for first-degree burglary. A charge of second-degree theft was dismissed.
Alex Levitsky, 38, was sentenced Oct. 5 to 90 days suspension of a driver’s license and 10 days with the Oregon Dept. of Corrections based on a no-contest plea to unauthorized use of a vehicle and two counts of recklessly endangering another person. Charges of second-degree kidnapping and third-degree criminal mischief were dismissed. He was sentenced in a separate case to two consecutive terms of 15 months with the Dept. of Corrections and 24 months post-prison supervision based on a no contest plea to four counts of aggravated harassment. Charges of attempt to commit a felony, first-degree criminal mischief and recklessly endangering another were dismissed.
Jay Boyd Marsh, 57, was charged Oct. 13 for second-degree escape from a correctional facility on July 18.
Samuel Armstrong Monroe, Jr., 45, was charged Oct. 19 with felon in possession of a firearm, pointing a firearm at another, menacing and unlawful use of a weapon. Bail was set at $5,000.
Ricky Paul Nelson, 22, was sentenced Oct. 12 to 13 months with the Oregon Dept. of Corrections and fined $6,700 to a victim based on a plea of no contest to first-degree theft; a second count of first-degree theft was dismissed. Charges of third-degree robbery, first-degree theft, unauthorized use of a vehicle and harassment in a separate case were dismissed Oct. 18.
Zachary E. Pekar, 42, was charged Nov. 2 with unlawful use of a weapon and felon in possession of a weapon when he allegedly discharged a firearm within city limits.
Trevor Charles Ray, 30, was charged Oct. 18 with two counts of failure to report as a sex offender.
Tristan William Richardson, 20, was sentenced Oct. 20 to 96 hours jail, 24 months bench probation, and $200 in fines based on a guilty plea to assaulting a public safety officer and recklessly endangering another person.
Jason Robert Skyles-Lutzi, 27, was sentenced Oct. 12 to a three-year suspension of a driver’s license, 240 hours jail, 36 months bench probation and $2,255 in fines based on a no contest plea of DUII with a .15% BAC and recklessly endangering another person. A reckless driving charge was dismissed.
Tara Ann Stanley, 32, was charged Oct. 14 with first-degree theft, allegations involving theft from Fred Meyer.
Joshua Joe Tallman, 32, was charged Oct. 12 with unauthorized use of a vehicle.
Aundra Dawn Tillotson, 24, was charged Oct. 24 with resisting arrest and two counts of assaulting police officers Chad Christenson and Alan Baker. Bail was set at $25,000.
Joseph Robert Vargas, Jr., 38, was charged Oct. 25 with reckless driving, fleeing, failure to perform duties of a driver when property is damaged, and recklessly endangering another person.
Devin Shawn Walling, 26, was charged Nov. 3 with third-degree assault for allegations involving a child 10 years old or younger.
LEBANON MUNICIPAL COURT
Damion Michael Aragon was sentenced Oct. 25 to one year suspension of driver’s license, eight days jail, 60 months bench probation, and $1,855 in fines and fees for DUII.
Allan James Azzopardi was sentenced Oct. 5 to a one-year suspension of driver’s license, 48 hours jail, 60 months bench probation, and $1,355 in fines and fees for DUII.
Paul Mejia Rodriguez was sentenced Oct. 25 to the diversion program for DUII.

2:35 a.m. – Caller reported two males with bikes entered the back of a neighbor’s plumbing van, Hazel St. They left when they saw they were being watched. A responding officer found the van with its doors open and keys in its ignition. He made contact with the owners,who said they always leave the van unlocked and often leave a purse there as well. He tried to counsel the owners about the potential for theft, and the male defensively argued with the officer. Several hours later, Chad Zurcher called to report the theft of items from the van.

6:07 p.m. – Officer responded to a call about juveniles shooting a BB-type gun in the parking lot of Lebanon High School, 1700 S. Fifth St. A juvenile admitted to playing with his waterbead gun and agreed to be more careful about using gun-looking objects on school property.
7:06 p.m. – Caller reported two juveniles driving dirt bikes, Main St.
9:45 p.m. – Caller reported that the driver of a yellow Hummer was unable to maintain lane at varying speeds, driving in the center lane, and entering oncoming traffic, Airport Road. An officer was unable to locate the car, but received owner info from the license plate number.
10:32 p.m. – Levi Joe Newberg, 31, was cited for driving while suspended and for a Lebanon Justice Court warrant for contempt of court, a Lebanon Municipal Court warrant for probation violation and Sweet Home Municipal Court warrants for failures to appear on original charges of second-degree theft and second-degree criminal mischief.
Oct. 28
7:35 a.m. – Deputy located a trailer creating a traffic hazard in the 200 block of Alder St. While removing the trailer from the roadway, it was discovered that the vehicle on the trailer, a 2001 Honda Accord, had been stolen from Sweet Home on July 21. The trailer was towed and the vehicle was returned to the owner. Report taken.
7:57 a.m. – Nicholas Cupparo, 28, of Corvallis, was cited for speeding, 94/55, following too close and careless driving. 41600 block of Keel Mountain Drive.

11:44 a.m. – A firearm was reported stolen from a vehicle in the 900 block of Cascade Drive. According to the Sheriff’s Office, a Smith and Wesson .380-caliber handgun was stolen from a 2004 Chevy Silverado parked at the caller’s residence. Report taken.
1:04 p.m. – Caller reported a male passenger threw items from a car window, hitting the caller’s car, Santiam Hwy. At the light, the driver allegedly slammed on his brakes, got out, yelled at the caller and punched the car window.

12:46 a.m. – Michael James Van Gundy, 45, was charged with domestic harassment involving an alleged fight at Ralston Park.
8:29 a.m. – Caller reported a neighbor threatening to shoot or poison cats for getting on his car, Milton St. The caller offered to buy the neighbor a car cover, which he declined.
9:16 a.m. – A report was taken for the theft of a blue Geo, Hiatt St. The car was located and returned later in the day.
9:34 a.m. – Caller reported someone had drilled into his car’s ignition switch, Grove St. Damage valued at $75.
10:48 a.m. – Caller reported the theft of a double-stroller from behind a garage, Wheeler St. Loss valued at $700.
10:53 a.m. – Caller reported a male stealing firewood, 32900 block of Tennessee Road. Requested it be documented.
12:06 p.m. – Vehicle stolen from Lebanon recovered in the 39200 block of Myers Place, Scio. A 2006 Subaru Impreza had been stolen from within the city of Lebanon and reported to Lebanon Police. Owner had located the vehicle, and the Sheriff’s Office responded to aid in recovery. Report taken.
1:41 p.m. – Caller reported the theft of 15 bags of cans and bottles, 7th St.
2:16 p.m. – Durrell Monroe Borden, 42, was cited for a Linn County Circuit warrant for failure to appear on an original charge of first-degree trespass.
3:17 p.m. – Caller reported the theft of a wiener/cocker spaniel puppy, Milton St. Caller said she let an identified female hold the puppy, and when she went back to retrieve it, both were gone. Police are looking into the matter.
5:14 p.m. – Caller reported the theft of items from a car in the area of Berlin/Bellinger Scale roads. Caller left his vehicle parked on the side of the road near the Mallard Creek Golf Course. A shotgun, flashlight, coolers, first-aid kit and pill were stolen. Approximately $900 loss. Report taken.
6:39 p.m. – Caller reported a neighbor attempting to burn her inflatable Halloween decoration, Red Arrow Drive. The neighbor admitted to the act and was cited for second-degree criminal mischief.
6:44 p.m. – Glenna Adams, 68, of Sweet Home, was cited for failure to obey a traffic control device. Hwy. 34/Agan Road.
9:19 p.m. – A report was taken for a broken car window and theft of a purse, 8th St.
10:50 p.m. – A single vehicle went into a ditch in the 38700 block of Golden Valley Drive. Noninjury. Juvenile driver in 2002 Chevy Silverado. According to the Sheriff’s Office, speed appeared to be a factor in the crash. Report taken.
11:13 p.m. – A report was taken for the theft of a laptop, luggage, handgun and other property from a hotel room, Main St. Loss valued at $5,000. Officer determined the items were possibly removed by the cleaning staff after mistakenly checking the victim out. A video showed an employee moving a garbage bag with unknown items from the laundry room to a personal car. The gun was returned the following day.

3:27 a.m. – Stolen vehicle recovered in the 32800 block of Berlin Road. The vehicle was reported stolen by its owner in September from Sweet Home. It was then recovered by the owner, who, however, failed to notify law enforcement. The owner gave permission for someone to use the vehicle, and when a deputy made a traffic stop on it, it was found to still be listed as stolen. Since it was no longer listed as stolen, it was removed from LEDS/DMV as stolen.
8:17 a.m. – Caller reported a motorcycle theft, Morton St. It was later found near storage units on Airport Road. Report taken. Video evidence is being reviewed.
11:37 a.m. – A noninjury crash was reported in the 30900 block of Waterloo Road. A vehicle left the road due to wet, slick conditions. Minimal damage to a fence, according to the Sheriff’s Office. Information exchanged.
5:33 p.m. – Report taken for car hitting pedestrians, Main St. James B. Rochefort, 64, was cited for failure to yield to a pedestrian. Two victims were transported to Corvallis by medics.
6:01 p.m. – Caller reported a male subject attempting to steal from a store had pushed her, Santiam Hwy. An officer said the incident might qualify as “robbery” since the subject used force.
9:41 p.m. – Emily Ray Nelson, 22, was cited for a Lebanon Municipal Court warrant for contempt of court.
11:00 p.m. – Caller reported theft of services, Vine St. The caller, a Salem locksmith, informed the subject of a fee for responding to a request to reprogram a key fob regardless of whether it was possible. The key could not be fixed, but the subject refused to pay the surcharge fee.

12:27 a.m. – A noninjury crash was reported in the 700 block of Crowfoot Road. A single vehicle went into a ditch. Further information was unavailable.
12:45 a.m. – Joshua Theis, 23, of Lebanon, was arrested after allegedly assaulting longtime girlfriend. 5500 block of Santiam Hwy. Transported to Linn County Jail on charge of fourth-degree assault. Report taken.
1:27 a.m. – A report was taken for a pursuit of a pickup that reached speeds of 80 mph from Oak St. to Hwy. 34.
7:23 a.m. – Deputy assisted Oregon State Police with a game violation in the 29300 block of Sodaville Mountain Home Rd.
7:48 a.m. – Caller reported the theft of knives and cash from unlocked car, Main St.
8:53 a.m. – A female in a group home said that a male entered her room showing his private parts and made an inappropriate sexual request. The male said he thought they were friends and he was making a joke that went too far. The home will try to find another place for the male.
9:02 a.m. – Caller reported a motorcycle stolen from the 33600 block of Santiam Hwy. It was described as a multicolored Kawasaki valued at $2,000, stolen from the caller’s property. Report taken.
9:14 a.m. – Buffy Jean Gibson, 48, was cited for an Albany Municipal Court warrant for second-degree criminal trespass.
9:43 a.m. – Caller showed a video of a car driving for some time in the wrong lane on Brewster Lacomb Road.
10:09 a.m. – Caller reported a male causing issues and refusing to leave a store, Weldwood Drive. Jesse Lee Wilcox, 33, was trespassed from the store.
11:21 a.m. – Report taken for car crash, Main St. The driver of a van reported that an SUV driver said he wouldn’t provide insurance information because he wasn’t at fault, then left the scene. An officer contacted the SUV driver, Macedonio Robles Diaz, 74, and cited him for failure to maintain lanes. Estimated car damage: more than $2,500.
11:26 a.m. – An unknown suspect removed fencing material containing horses in the 31800 block of Fritz Lane. Because of this, a horse was cut. No suspects or leads. Property owner will be placing trail cameras.
5:34 p.m. – Witnesses said a car stolen the previous week, which contained several juveniles, was doing “cookies” and hit something at the park. An officer unable to locate the car or damage at the park, but saw skid marks from the “cookies.”
7:13 p.m. – Caller had reported the previous week that a male was responsible for a vehicle break-in. He didn’t steal anything that night, but he returned and attempted to enter the car, Birch St.
9:47 p.m. – Caller reported a female driver appeared to attempt to repeatedly hit a stoplight near Carl’s Jr., 525 Weldwood Drive. Other drivers helped push her car to a parking lot. The driver told an officer she was on her way home and misjudged the turn. There were no signs of impairment. She was given a ride home since her car had a radiator fluid leak.

8:16 a.m. – Caller reported that the previously trespassed man put on a pair of shoes and went to the register but would not pay for them, Wilco Farm Store, 2950 S. Santiam Hwy. Employees said they’d felt threatened by him in the past. Jesse Wilcox was cited for third-degree trespass.
8:29 a.m. – Caller reported the theft of a bill of sale of a just-purchased car, Elmore St.

8:42 a.m. – Caller reported a transient camp at Ralston Park. Aundra Dawn Tillotson, 24, was cited for a Lebanon Municipal Court warrant for probation violation – second-degree trespass, a Linn County Circuit Court warrant for failure to appear on an original charge of first-degree burglary and an Albany Municipal Court warrant for failure to perform the duties for property damage.
2:16 p.m. – Jacob Lynn Goodwin, 27, was cited for driving while suspended and uninsured, Mary St.

3:12 p.m. – Officer responded to a fight between females, Park St. A driver took a friend to Lebanon and asked for more gas money. The friend said no, the driver yelled and threw cigarettes at her, then the friend hit the driver, who said she suffered from PTSD and starts yelling when she’s upset. The friend said she was autistic and triggered by yelling. The friend tried to make amends but the driver left her in town. An officer gave her a ride home to Albany.
4:32 p.m. – Caller reported that a customer paid only $5 for a $12.95 meal at Bigfoot Grille, 525 S. Main St.
5:23 p.m. – Bus driver reported that political signs at 5th and Tangent streets were impeding traffic visibility.
6:34 p.m. – Caller reported that a male was following him around Walmart, which had happened several times in the previous couple of days. The male called and said that the caller followed him home from Walmart. Both parties were counseled about obtaining stalking orders.
7:27 p.m. – Caller reported the theft of a vacuum, dogfood, spray paint and other items from a store, Santiam Hwy.
7:33 p.m. – Report taken for felony hit-and-run, Main St. A bicyclist was traveling northbound in the northbound lane. A southbound pickup in that lane attempted to make a left turn onto Jennings St. and struck the bicyclist. The pickup’s driver allegedly stopped momentarily before speeding off. Medics transported the bicyclist to Good Samaritan Hospital.
8:03 p.m. – Report taken for a two-vehicle crash, Main St. Clayton Edward Cooke, 61, was cited for driving uninsured. It was reported that he’d hit a parked truck.

6:05 a.m. – Caller reported the theft of a Nissan Sentra while the caller made a quick stop at a store and left the car running, Grant St. Officer identified a Honda Civic parked next to the Sentra and the passenger stole the car. The Sentra was located and returned three days later.

11:31 a.m. – Caller reported her uncle harassing her and almost hitting her with a truck because she reportedly wouldn’t pay his rent, Elmore St.

11:41 a.m. – Caller reported a person in a red Tahoe taking pictures of their house and speeding away, 10th St.

1:45 p.m. – Caller reported a female and male in a black van with a white roof looking into parked cars at Taco Bell. Responding officer trespassed the subjects for one year.
2:52 p.m. – Report taken for the theft of a Multnomah County Correction Department officer’s go bag, firearm and equipment from car, Hiatt St.
3:04 p.m. – Report taken for a pug puppy who had bitten a 4-month-old, 8th St. Puncture wounds were found, but no broken bones. A quarantine order was issued.
4:48 p.m. – Police attempted contact with Acea Lee Clark Anderson, 30, who had warrants, 2300 block of Fuller Lane. One individual was at taser point and a K9 was employed. Four total subjects were detained, including Anderson, who was cited for a Marion County Circuit Court warrant for three counts of unauthorized use of a vehicle; an Oregon State Parole Board warrant for probation violation; Linn County Circuit Court warrants for failure to appear, violation of wildlife permit, giving false information, fleeing, unlawful possession of methamphetamine and felon in possession of a firearm; and a Lebanon Justice Court warrant for driving while suspended. 5:29 p.m. – Caller reported a male in a tan SUV sitting in the Sand Ridge Charter School parking lot and staring at it, 100 Sand Ridge Court. Responding officer contacted a female who said she was working on her car in the parking lot because she was not allowed to do so in the lot of the neighboring complex where she lived.
5:31 p.m. – Caller reported the theft of a backpack, speaker, headphones and a jersey from a car, 5th St. Loss valued at $250.
8:03 p.m. – Caller reported being bitten by a small terrier, Tangent St. Officer saw a small scratch with blood on her ankle. It was determined that a young girl had the dog on a leash when she took the garbage out, and the dog was barking at the neighbor, then purportedly bit her. A quarantine was issued.

7:39 a.m. – Deputy contacted a male whose truck was partially blocking a CTC gate in the 28900 block of Ingram Road. The truck was removed and its driver was trespassed from CTC land. According to the Sheriff’s Office, the subjects were from Molalla and had parked in front of the gate while hunting in the area.
11:08 a.m. – Shane Wells, 46, of Sweet Home, was cited for failure to obey a traffic control device, driving while suspended, Santiam Hwy./Groshong Road.
11:48 a.m. – Caller reported the theft of a phone charger, car registration and handicapped placard from a car, Park St.

8:41 a.m. – Darrell Gene Mullenix, 48, was taken into custody for probation violation, Park St. It was reported that he had a conditional release from Lebanon Municipal Court prohibiting him from contact with the entire city of Lebanon. Report taken.
8:42 a.m. – Caller reported a male under a truck allegedly attempting to steal a catalytic converter, Ash St. The male was located and he told an officer that he was admiring the suspension on the new racing truck. His bag was searched and no tools or stolen items were found.
9:31 a.m. – Caller reported two kids taking bikes from his neighbor and dropping them, Acorn St. He said this was their second theft attempt.
9:36 a.m. – Report taken for a fake $20 bill passed to Subway in Walmart.
11:27 a.m. – Brittany Lynn Hull, 28, was trespassed for life from Rite Aid and cited for an Albany Municipal Court warrant for interfering with police.
12:41 p.m. – A person reported that he had been sideswiped by a male two weeks previously and that Benton County handled the crash report, but the male (who had obtained his address during the crash) drove next to him that morning, told him to pull over, said he would kick his a**, then weaved in his lane to force him to stop. The person wanted the information documented in case the situation escalated.
1:09 p.m. – Caller reported that two males attempted to enter a neighbor’s house, Oak St. Vincent Lee Holt, 51, was cited for first-degree attempted burglary and second-degree criminal trespass, and cited for Linn County Circuit Court warrants for failures to appear on original charges of possession of methamphetamine, DUII, reckless driving; a Lebanon Justice Court warrant for disorderly conduct; an Albany Municipal Court warrant for third-degree criminal trespass; a Lebanon Municipal Court warrant for probation violation – third-degree theft; a Sweet Home Municipal Court warrant for failure to appear on an original charge of second-degree disorderly conduct; and a Philomath Municipal Court warrant for resisting arrest. Wesley Alan House, 39, was cited for probation violation for second-degree disorderly conduct.
2:04 p.m. – Female reported that while she walked around the hospital, a male approached, asked personal questions, grabbed her arm, touched her head, told her that she was sexy and gave her a business card with the name Shawn Gourley on it. The officer contacted Gourley who admitted to the sexual comments but denied touching her.
6:04 p.m. – Caller reported mail theft over a period of several days Main St. Opened mail was found down the road.
6:51 p.m. – Caller reported a bald male who had earlier attempted to open a door and window and was arrested had returned and was standing in the yard, Oak St.
11:27 p.m. – Michael James Mansell, 24, was cited for a Lebanon Municipal Court warrant for failure to appear.
